PAIA & POPIA Manual
Prepared in accordance with section 51 of the Promotion of Access to Information Act, 2000 (PAIA) and to address the requirements of the Protection of Personal Information Act, 2013 (POPIA).

2. Purpose of this manual
PAIA gives effect to the constitutional right of access to information held by the State and by another person where that information is required for the exercise or protection of any rights. This manual sets out the procedure to be followed when requesting access to records held by The Auto Shed, and does so in a manner which balances that right against other rights, including those contained in the Bill of Rights.
This manual also recognises the role of the Information Regulator, which is responsible for regulating compliance with PAIA and POPIA by private and public bodies.
3. The Information Officer
The Auto Shed has appointed an Information Officer to assess requests for access to information and to oversee its functions in terms of both PAIA and section 55 of POPIA. The Information Officer may appoint Deputy Information Officers where necessary.

4. Guide of the South African Human Rights Commission
PAIA grants a requester access to records of a private body if the record is required for the exercise or protection of any rights. Requests must be made in accordance with the prescribed procedures and at the prescribed rates.
Requesters are referred to the Guide compiled by the South African Human Rights Commission in terms of section 10 of the Act, which is available from the Commission:

5. Notice in terms of section 52(2)
No notice has been published on the categories of records that are automatically available without a person having to request access in terms of section 52(2) of PAIA.
6. Categories of records available on request
The following categories of records are held by The Auto Shed and are available only on request in terms of the Act. The full, itemised schedule appears in the downloadable manual.
Companies Act records
Documents of incorporation, Memorandum of Incorporation, statutory registers, minutes of board and shareholder meetings, share register and resolutions.
Financial records
Accounting records, annual financial statements, asset registers, bank statements and banking details, invoices and audit records.
Income tax records
Records relating to PAYE, SARS returns, VAT and other statutory tax obligations.
Personnel records
Employment contracts, payroll and remuneration records, disciplinary records, leave records and training records.
Client and supplier records
Client and supplier agreements, correspondence, credit applications, vehicle sale and purchase records.
Operational records
Insurance records, marketing material, internal policies and procedures, and information technology records.
7. How to request access to a record
A request must be made on the prescribed form (included in the downloadable manual) and submitted to the Information Officer at the address or email address above. The request must:
• provide sufficient particulars to enable the record to be identified;
• identify the right that the requester is seeking to exercise or protect, and explain why the record is required to exercise or protect that right;
• indicate the form of access required and the manner in which the requester wishes to be informed of the decision; and
• provide the requester’s contact details within the Republic.
The prescribed request fee and access fees, where applicable, are set out in the fee schedule contained in the manual. The Information Officer will respond within the periods prescribed by the Act.
8. Processing of personal information (POPIA)
The Auto Shed processes personal information in accordance with POPIA. Details of the categories of data subjects, the purposes of processing, recipients of personal information and the security measures applied are set out in the manual.
